How much compensation will I receive for my Personal Injury?

The amount of compensation you received will be based on two different elements and can vary massively depending on the circumstances and severity of the injury.

When valuing a claim, we consider two different elements of compensation are General Damages and Special Damages.  The first is an award for Pain, Suffering and Loss of Amenity (known as General Damages) which reflects the type and extent of injury you suffered.

The second element is for the financial losses and expenses that you otherwise would not have suffered and incurred had the accident and consequential injuries not occurred (known as Special Damages). Such an award can compensate you for both past and future losses.  These can include, but are not limited too: 

  • Care and Assistance
  • Travel expenses
  • Medical expenses
  • Aids and equipment
  • Past Loss of Earning / Future Loss of earnings
  • Accommodation / Adaptations to the home

Every claim is different therefore the merits of your injury will determine the damages you receive. Medical Evidence will be required to assess your General Damages and it will be for a Medical Expert to determine your injury, recovery and prognosis period. Based on the expert’s opinion your claim will be valued and your Special Damages assessed.

Do you offer No Win No Fee?

Yes, T G Baynes Solicitors can act for you on a No Win No Fee Basis, these are also known as Conditional Fee Arrangements.   

Essentially, with a No win no fee, you will not have to pay anything if the claim is unsuccessful. But if the claim is successful, whilst the majority of your legal costs will be paid by your opponents, we will deduct the following from your damages:

  • Success fee of up to 25% of your damages
  • The cost of your ATE insurance pay (if needed)
