Claims against GP Out of Hours

Normally if we are feeling unwell, our first port of call is our GP where you may see a GP or Nurse Practitioner. It is important to remember that they are not experts in each type of illness, but have a responsibility to assess the clinical picture presented in front of them and determine which specialist is required, if any, and to facilitate any referral on within the timelines recommended. Sometimes, it is not necessary to refer on and the GP/NP can provide treatment themselves. They owe a duty of care to you to ensure that the decisions taken are reasonable.

However, sometimes errors are made. It could be that they have not recognised a particular symptom that could be masking a more serious underlying condition or there may be a delay in them referring you on for treatment. GPs may also make prescribing errors – perhaps they have mistakenly prescribed you with the wrong medicine, or at the wrong dosage. Perhaps it was only the pharmacist who may have noticed it when they have gone to dispense it. If this error has gone on to cause an injury over and above that which you would have had in any event, you may be eligible for compensation.

At T G Baynes we have experience of helping victims of medical negligence by their GP to claim for the compensation they deserve. It may not be your priority to think of making a claim if you have been a victim of medical negligence by your GP, but it could be worth thinking of the impact their error has had – or could have had - on you and your family as time goes on.

Adopting a sensitive approach to ensure that all of the facts about the medical negligence are uncovered, it is important to us at T G Baynes that we are sensitive to your needs and any concerns you may have. We are experienced in helping victims of medical negligence to understand what went wrong during their experience with their GP.

We know that starting a legal process can seem daunting, and we will always listen to you and expertly guide you through the legal process from start to finish, providing you with the full facts of your case at all times and being on hand to provide the legal support you may need at this time.
