Claims against GP Out of Hours
Normally if we are feeling unwell, our first port of call is our GP where you may see a GP or Nurse Practitioner. It is important to remember that they are not experts in each type of illness, but have a responsibility to assess the clinical picture presented in front of them and determine which specialist is required, if any, and to facilitate any referral on within the timelines recommended. Sometimes, it is not necessary to refer on and the GP/NP can provide treatment themselves. They owe a duty of care to you to ensure that the decisions taken are reasonable.
However, sometimes errors are made. It could be that they have not recognised a particular symptom that could be masking a more serious underlying condition or there may be a delay in them referring you on for treatment. GPs may also make prescribing errors – perhaps they have mistakenly prescribed you with the wrong medicine, or at the wrong dosage. Perhaps it was only the pharmacist who may have noticed it when they have gone to dispense it. If this error has gone on to cause an injury over and above that which you would have had in any event, you may be eligible for compensation.
