Birth Injury Compensation Claim Mothers

Pregnancy is often a joyous occasion; however, it is natural that during pregnancy and labour you may feel anxious or concerned. There are often medical procedures that are required and often many medical staff in the room with you and your family at the time which can daunting.

It is natural to put your complete trust in the medical team to look after you and your child. However, if the negligent actions of your midwife or doctor cause the standards of the care you are receiving to slip leading to injury to you or your child suffering an injury, this can be a distressing and shocking time for you.

Injuries to a birth mother do happen throughout the normal course of labour and are not necessarily due to negligence. For example, the need for episiotomies and sometimes unavoidable injury can occur, but if your midwife or doctor has perhaps overlooked something, forgotten to complete a procedure (or completed a procedure to an unreasonable standard) or not taken the advice of other medical professionals in the room with you, it can lead to injuries being caused by negligence. In this instance, you and your family may be able to claim for compensation which will ensure that any long-lasting effects of the injury can be properly supported and rehabilitated.

There are often a number of different ways that a birth mother can be injured negligently in labour. Physical injuries such as abnormal or excessive bleeding in the uterus, abnormal bruising, infection and vaginal tears to varying degrees are experienced. Sometimes the placenta is not completely evacuated from the body following birth leading to problems. These are a handful of examples and is not an exhaustive list. It is important to note that sometimes these injuries are unavoidable and not due to negligence.

As well as physical injuries, mental injuries can also be caused by negligence through labour, and some new mothers have experienced Post Traumatic Stress Disorder (PTSD) as a result of the issues they have experienced within their labour and we can also assist with these claims.

If you believe that you have experienced negligence during your labour, you will of course be feeling incredibly upset, hurt and distressed and you will likely be in pain and possibly need to undergo even more medical treatment as a result. We support you at all stages through the litigation and rehabilitation process.
